These Terms of Use (“Terms”) govern your access to and use of the GoodBoys.Club website (the “Site”) and its services.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you should refrain from using the Site. These Terms apply in addition to our Terms of Sale, "CGV", (for purchases) and our Privacy Policy.

1. Definitions and Operator Identity

GoodBoys.Club (hereafter “we”, “us”, “our”) is a private online boutique and community platform operated by Unstatic Labs (USL), a French SAS company (SIREN 983 982 950) with registered office at 60 rue François Ier, 75008 Paris, France.

Good Boys Club and Good Boys Obey are brands of USL, and the domains goodboys.club and goodboysobey.com are owned by USL.

The term “Site” refers to the GoodBoys.Club website and any related services or content provided. The term “User” or “you” refers to any person who accesses or uses the Site, whether as a visitor or as a registered member.

The Site is intended for adult users only. By using this Site, you certify that you are at least 18 years old (or the legal age in your country to view adult-oriented content) and have the legal capacity to enter into agreements. We age-gate our content accordingly, and no part of the Site is directed to minors.

2. Account Registration and Membership

Private Membership: GoodBoys.Club is a private sales platform – an account (membership) is required to view prices, access certain content, and make purchases. Membership is free. You may register by providing a valid email (we may use email link authentication) or by using a supported social login (e.g., via Telegram). By creating an account, you agree to provide truthful and accurate information.

You are responsible for maintaining the confidentiality of any login credentials or secure links, and for all activities that occur under your account.

We offer login via Telegram and other social logins for convenience; however, we are not affiliated with Telegram nor any of the social login providers in any way. Using Telegram login means you allow us to receive basic account information from your Telegram profile to authenticate you, as per Telegram’s login permissions. Your use of Telegram is governed by Telegram’s own terms and privacy policy. We do not assume responsibility for any issues arising from Telegram’s services.

Account Use: Each individual is generally allowed one account. You must not impersonate anyone or create multiple accounts to bypass restrictions. Membership and access to the Site is personal; you agree not to share your account with others. We reserve the right to refuse, suspend, or terminate an account at our discretion if we suspect unauthorized use, violation of these Terms, or other harmful behavior.

Access Tiers: Please note that not all sales, content, or features may be available to all members. We may restrict certain special collections or events to select users based on criteria such as prior purchases, participation in community events, or other loyalty factors. We will indicate when content is restricted and what criteria apply. There is no guaranteed right for every member to access all areas of the Site.

3. Permissible Use of the Site

You agree to use the Site in accordance with these Terms and all applicable laws and regulations.

The Site is provided for your personal, non-commercial use (except as may be expressly allowed, such as in the case of authorized affiliate partners or vendors in our marketplace – see Section 8).

Prohibited Conduct: You must not engage in any of the following on or in relation to our Site:

  • Illegal or Harmful Content: Posting or transmitting any content that is unlawful, illegal, or that promotes any illegal activities. This includes (but is not limited to) content that is defamatory, harassing, threatening, hate speech or incitement to violence, fraudulent, or that violates any third-party rights (intellectual property rights, privacy rights, etc.).
  • Sexually Explicit Content: While our site may feature sexually suggestive or fetish-oriented content, we do not allow hardcore pornographic material or any content depicting sexual activities. Nudity in a non-explicit, artistic or product-related context may be permissible, but any content featuring real sexual acts, exploitation, or minors is strictly forbidden. Users should refrain from uploading images or media that violate these standards.
  • Personal Data and Privacy Violations: Do not post personal data of others (e.g., names, addresses, contact details) without consent, nor any content that violates someone’s privacy or rights of publicity.
  • Malicious Technical Acts: No introduction of viruses, malware, or any code harmful to the Site or its users. Do not attempt to gain unauthorized access to any part of our Site or servers, or disrupt the normal function of the Site (e.g., through denial of service attacks, spamming, or hacking).
  • Circumvention and Misuse: Do not use bots, scrapers, or other automated means to access or extract data from the Site without our prior and explicit permission. Do not attempt to circumvent any access restrictions or security measures on the Site. Any attempt to reverse-engineer the platform, or to use our Site for purposes other than its intended use (for example, using it to advertise unrelated products or services), is strictly prohibited.
  • False Affiliation or Endorsement: You may not misrepresent yourself as an agent, affiliate, or representative of GoodBoys.Club or USL without our prior written agreement. While we encourage fan engagement (see Section 7 on User Content), you must not claim any official partnership or endorsement by us if none exists.

Violation of any of the above may result in immediate termination or suspension of your account, removal of offending content, and possible legal action. We reserve the right to take down any content that, in our judgment, violates these Terms or is otherwise objectionable, without prior notice.

4. User-Generated Content (Reviews, Media, Comments)

The Site may allow users to contribute content, such as product reviews, ratings, comments, or photos of themselves with our products (“User Content”). By submitting any User Content on our Site, you agree to the following:

  • Ownership and Rights: You retain ownership of the content you create. However, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, copy, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content (in whole or part) for any purpose, including but not limited to display on the Site, marketing, social media promotion, or other commercial uses relating to our brand and products. This license survives even if you remove the content or if your account is terminated, for the usages already made or prepared. (For example, if you post a photo review of a product, we may feature it on our website or Instagram feed or in advertising materials). We will whenever reasonably possible credit you by username or as appropriate, but you give us permission to use the content you uploaded to our platform without requiring further approval from you.
  • Content Standards: All User Content must comply with the standards set out in Section 3 (no illegal, infringing or prohibited material). You are solely responsible for the content you publish. Ensure that any photo or media you post does not contain nudity or explicit sexual acts, no other persons unless they consented, and no visible trademarks or branding of others in a manner that could cause confusion.
  • Rights and Permissions: By posting content, you affirm that you have the necessary rights and permissions to share that content. For example, you must have taken the photo yourself or have permission from the photographer; you must have consent from any identifiable persons in it; and the content must not infringe on copyrights, trademarks, or other rights of any third party.
  • No Compensation: You understand that you will not be compensated by us for any content you submit or for our use of it (unless separately agreed in a specific influencer/affiliate agreement).
  • No Confidentiality: User Content is considered non-confidential and non-proprietary. Even in areas that are members-only, assume that what you post could potentially be seen by other members. Do not share anything you wouldn’t want to be public.

We do not pre-screen all User Content, but we reserve the right (though not the obligation) to monitor, edit, or remove any User Content at our discretion. This may happen if content violates our Terms, someone reports it as illegal or inappropriate, or for any other reason we deem fit.

We are not liable for content posted by users, but we will act expeditiously to remove or disable access to any content that is reported as illegal or violative of these rules, in compliance with the Digital Services Act (DSA) and other applicable laws.

Reporting Mechanism: If you encounter User Content that you believe is illegal, harmful, or in breach of these Terms, please notify us through the provided channels (e.g., use any “Report” feature if available next to the content, or email us at [email protected] with the details including a link or description of the content). We have established a procedure to handle such notices in line with the DSA requirements. We will review notifications promptly. If the content is found to violate the law or our policies, we will remove or disable it and possibly sanction the user who posted it.

When we remove or restrict content that you have posted, we will, to the extent required by law, inform you of the removal and the reasons (for example, via an email or notification), unless the issue is manifestly minor or we are prevented from doing so by law. If you believe your content was removed or your account was suspended unfairly, you may appeal by contacting our support (reply to the notice or email [email protected]), providing reasons why you think the action was not justified. We will review appeals impartially and reinstate content or accounts if the removal/suspension was in error. Additionally, as an EU user, you have the right to seek out-of-court dispute resolution for content moderation issues under the DSA, though for our small platform, the primary recourse is through our internal complaint-handling system.

5. Intellectual Property Rights

Our Content: All content on the Site (other than User-Generated Content as discussed above), including text, graphics, logos, images, videos, designs, software, and trademarks, is the property of USL or its content licensors and is protected by intellectual property laws.

Specifically, the Good Boys Club and Good Boys Obey names and logos are trademarks of USL (registration pending). No license or rights to use any of our intellectual property is granted to you by mere use of the Site, nor by placing a purchase.

You may not copy, reproduce, distribute, publicly display, or create derivative works of any content from our Site without our express prior written permission, except as permitted by law (such as brief quotations for commentary or fair use). For example, you should not scrape or aggregate our product images or descriptions to use on another site.

Third-Party IP: The Site may display certain third-party trademarks or content (for instance, a product that incorporates a branded component, or affiliate logos, etc.). All third-party trademarks are the property of their respective owners, and their appearance on our Site does not imply any affiliation with or endorsement by those third parties unless explicitly stated. You must not use any third-party trademarks shown on the Site in a way that would cause confusion as to the source or association.

User’s Permitted Use: You are authorized to use the Site and its content for personal, non-commercial purposes only. This means you can browse our pages, share links to our content, or print a copy of portions of the site for your personal reference. If you are a legitimate participant in our affiliate or influencer program (with an agreement in place), you may use certain provided materials as allowed by that program’s terms. However, absent a specific agreement, you cannot use our brand names, logos, or content to imply a partnership or to derive commercial benefit.

We do welcome and encourage fan engagement and personal promotion: for example, you are free to take pictures of yourself with our products and share them on your personal social media, or write blog posts reviewing our products, as long as such use is truthful and not derogatory. In doing so, you can refer to our brand names (nominative fair use) – e.g., “Check out my new collar from the Good Boys Club!” – but you must not do anything that suggests you are officially partnered with us when you are not. If in doubt, please contact us for clarification or permission.

The Site may contain links to or integrations with third-party websites and services for your convenience or as part of collaborations. Examples include:

  • Links to social media (our Instagram page, etc.) or to third-party content about our brand.
  • Affiliate or referral links that direct you to external sites or offers.
  • Payment providers (Revolut, PayPal, Stripe) that handle transactions.
  • The Telegram login integration and Telegram bot for customer support.

Third-Party Terms: If you access any third-party content or service via our Site, you do so at your own risk. Those third-party services have their own terms of use and privacy policies, which we encourage you to review. We do not have control over the content or practices of third-party sites. We do not assume any responsibility or liability for any third-party websites, services, or content. A link or integration on our Site does not imply that we endorse or verify the third party’s offerings or that we have any partnership beyond what is stated.

For example, if we provide an affiliate link to a partner’s product, and you click it, any purchase you make on the partner’s site is between you and that partner, under their terms. Similarly, when you use PayPal or Stripe to pay, you are subject to their user agreements during the payment process. While we choose reputable partners, any issues arising from third-party services must typically be resolved with those third parties.

Collaborations and Promotions: From time to time, we may feature content from influencers or collaborators, such as a guest blog or a community showcase, or we may run promotions in conjunction with others (e.g., a discount code provided to an influencer’s followers). In such cases, we strive to clearly disclose the nature of the collaboration (for instance, if a post is an ad or sponsored, we will mark it accordingly). Even so, we cannot guarantee any specific outcome from a collaboration (like availability of special discount codes, etc.), and any promotions are time-limited per their specific terms.

If you as a user navigate to an external site or choose to engage with a partner offer, note that your personal data might be shared between us and the partner only as needed (for example, if you use an influencer’s code, we might inform the influencer of aggregate usage of their code, but we will not share your identity without your consent). More details may be found in our Privacy Policy regarding data sharing.

7. Disclaimers of Warranty

Site Provided “As Is”: GoodBoys.Club is provided on an “as is” and “as available” basis. While we endeavor to provide a great user experience, we do not warrant that the Site will meet all your expectations or that it will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You use the Site at your own risk.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site and its content. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or quality. For example, we do not guarantee that the colors of products as seen on your screen will be exactly the same in reality (though we strive for accuracy), nor do we guarantee that any user content is truthful or reliable.

No Professional Advice: Any information provided on the Site (such as blog articles on lifestyle, sizing advice, etc.) is for general informational purposes and does not constitute professional advice. You should consult appropriate professionals or resources for specific advice tailored to your situation (e.g., medical or safety advice regarding use of certain accessories, if relevant).

Content Warning: As noted, some content on our Site may be mature or suggestive. We attempt to moderate user contributions, but we are not responsible for any content that might be offensive to you. You acknowledge that by using the Site, you may encounter material that you consider adult-themed or otherwise not to your taste, and you waive any claims against us for any distress caused by such exposure (within the bounds of law, and provided such content does not violate our policies which we would remove once noticed).

8. Limitation of Liability

To the maximum extent allowed by applicable law, USL (GoodBoys.Club) and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of (or inability to use) the Site or the purchase of any products via the Site. This includes, without limitation, any damages for lost profits, loss of data, loss of goodwill, or other intangibles, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for all claims arising from or related to the Site or products (including liability for breach of these Terms, negligence, or other tort) shall not exceed the total amount you paid to us in the past six months, or €100, whichever is greater, unless a specific law requires otherwise.

Consumer Law Notice: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. If those laws apply to you, some of the disclaimers or limitations above may not apply to you to their full extent, and you may have additional rights. In particular, nothing in these Terms is meant to limit or exclude our liability in a way that is not permitted under applicable law. For instance, in France (where our company is based), we do not limit liability for gross negligence or willful misconduct, and the provided limitations do not affect your rights under French consumer protection laws. Similarly, any statutory remedies you have (like legal guarantee of conformity for products, as described in our CGV) remain fully applicable for product-related issues.

User Content and Interactions: We are not responsible for the conduct of our users, whether online or offline. If you have a dispute with one or more users or any third party (for example, a dispute between community members or between a user and a third-party vendor featured on the Site), you release us from all claims, demands, and damages of every kind arising out of or connected to such disputes, unless we are legally at fault. We simply provide a platform; the users themselves are accountable for their interactions.

9. Digital Services Act Compliance (Platform Obligations)

Because our Site allows users to post content (reviews, comments, etc.) and because we may act as an online marketplace for third-party vendors in some cases, we fall under certain obligations of the EU Digital Services Act (DSA). We are committed to maintaining a safe and transparent online environment. In practical terms, this means:

  • We have clearly defined in these Terms what constitutes illegal or unauthorized content (see Section 3), so users know the rules.
  • We provide tools for reporting problematic content or goods (see Section 4, “Reporting Mechanism”), and we ensure that such reports are handled promptly and diligently. We aim to decide on content removal after a valid notice within a reasonable timeframe.
  • We maintain a notice and action policy: when illegal content is reported to us, we will remove or disable it expeditiously and inform the notifier and the user who posted it of the outcome.
  • We also allow the poster to contest our decision (appeal process as described).
  • We have a policy and infrastructure to address notifications from authorities or court orders regarding illegal content, as required by law.
  • For any products sold by third-party traders on our Site (marketplace scenario), we implement Know Your Business Customer (KYBC) procedures as mandated by the DSA. We verify the identity and contact details of such traders before they can offer goods, and we will display the trader’s name and contact information on the product listing, so you (the consumer) know who you are buying from. In case a product listing is illegal (e.g., counterfeit or unsafe goods) and is reported, we will remove it and inform buyers if necessary.
  • We will cooperate with law enforcement or regulatory authorities when required, in accordance with applicable laws, to curb illegal activities online.

While the above measures are primarily legal obligations, we view them as part of our commitment to our community’s trust and safety. If you have any questions or concerns regarding content moderation or the integrity of our platform, please contact us.

10. Termination

You may stop using the Site and/or close your account at any time. If you wish to delete your account, you can contact us to request deletion of your data (see Privacy Policy for data deletion). We may retain certain transactional information as required by law, but your login and profile can be deactivated.

We reserve the right to suspend or terminate your access to the Site (or certain features of the Site) at any time, for any reason, with or without notice. Common reasons for termination include: breach of these Terms, prolonged inactivity, request by law enforcement, or discontinuation of the service. In the event of termination by us without cause, we may provide a prorated refund of any membership fee (if any was paid; currently membership is free). If termination is due to your misconduct or violation, you will not be entitled to any compensation.

Even after termination of your account, the provisions of these Terms which by their nature should survive (such as licenses granted by users, indemnification, disclaimers, limitations of liability, and jurisdiction clauses) will continue to apply.

11. Changes to the Terms or Service

We may amend these Terms from time to time, especially to accommodate new services, changes in the law, or improvements in our practices. If we make material changes, we will notify members by posting the updated Terms on the Site and updating the “Last Updated” date, and/or by sending an email notification or an on-site alert. It is important that you review any updated Terms. By continuing to use the Site after the new Terms become effective, you are indicating acceptance of the revised Terms.

If you do not agree to the changes, you should discontinue use of the Site and may request deletion of your account/data. For minor changes that do not materially affect your rights, notice may be provided by posting on this page only.

We also reserve the right to modify or discontinue the Site (or any part of it) at any time, temporarily or permanently, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the service, except to the extent expressly provided otherwise in a separate agreement.

12. Miscellaneous

Entire Agreement: These Terms (together with any documents incorporated by reference, such as our Privacy Policy and Terms of Sale) constitute the entire agreement between you and us regarding the use of the Site, superseding any prior agreements between us (whether oral or written) on the same subject. However, this does not supersede any specific written agreements you may have with us (for example, if you are also a supplier or affiliate under contract).

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remainder of the Terms will remain in full force and effect. For instance, if a limitation of liability is ruled unlawful in your jurisdiction, that specific clause will not apply to you, but the rest of the Terms will remain valid.

No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. Any waiver of any provision must be in writing and signed by an authorized representative of USL to be effective.

Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law or otherwise.

Relationship: No agency, partnership, joint venture, or employment is created as a result of these Terms or your use of the Site. You and we are independent contracting parties.

Headings: Section headings in these Terms are for convenience only and have no legal or contractual effect.

13. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. However, if you are a consumer located in another country, mandatory consumer protection laws of that country may apply for your benefit to the extent those laws are more beneficial to you than French law.

Jurisdiction: Any dispute arising from or relating to the use of the Site or these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Paris, France. You agree to the personal jurisdiction of these courts. If you are a consumer resident in the EU, you may also have the right to bring proceedings in your country of residence under certain conditions, but by this agreement you submit to the jurisdiction of the Paris courts (this does not override any rights you have to an EU-wide mechanism such as the European Online Dispute Resolution platform mentioned in the CGV, or to local courts if applicable law mandatorily allows it).

We also draw your attention to the possibility of using the EU’s Online Dispute Resolution (ODR) platform as described in our CGV, which is a tool you can use for resolving disputes related to online purchases or services.

Language: The official language of these Terms is English. Any translation (if provided) is for courtesy and information. In case of any discrepancy between the English version and a translated version, the English version of these Terms of Use shall prevail. All communications between you and us shall be in English or in French, unless we explicitly agree otherwise.
